SafestApartments.com operates a platform for apartment properties which it believes to be high in quality, in order to allow potential tenants find their next apartment. Advertisements on the Site are based on information provided by the properties or found on their individual website. Such information may change by the time a potential tenant contacts the property and while we strive to include the most accurate information, SafestApartments.com is not responsible in any way for the content in any such advertisements.
SafestApartments.com is not a lender or real estate broker, and the Site is therefore not intended to establish any agency, brokerage relationship or fiduciary relationship between you and SafestApartments.com. SafestApartments.com is not responsible for any actual lease transaction between a property and a potential tenant.

SafestApartments.com is a rental search technology platform owned and operated by SafestApartments.com. Rental advertisements as well as any related services that are accessible on SafestApartments.com or through various services, tools, or applications are acquired, managed and provided by SafestApartments.com and affiliates and subsidiaries, if applicable.

User Content, Your License to Us and Rules for User Content
By submitting communications, photos, data, information, reviews/opinions or any other content ("User Content") to SafestApartments.com or the Website, you are (i) authorizing us to use such User Content (including, where applicable, your name, image and likeness) and (ii) granting us a limited, non-exclusive, royalty-free, irrevocable right and license to copy, use, distribute, reproduce, modify, display, perform, create derivative works from, store and otherwise use such User Content, in any media known now or in the future. You represent and warrant that you have sufficient rights in the User Content to make this grant. You understand and agree that User Content submitted through the Website is not confidential or proprietary.
SafestApartments.com may provide certain opportunities for you to provide opinions or reviews ("User Commentary"). User Commentary must not violate these Terms of Service. In addition, you represent and warrant that User Content and User Commentary submitted by you does not:
- Promote sexually explicit, pornographic material or violence;
- Promote any illegal activity, or advocate, promote, or assist any unlawful act;
- Contain anything that is discriminatory based on race, color, sex, religion, nationality, disability, sexual orientation, gender identity or age;
- Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable;
- Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Service;
- Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.
- Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person;
- Be likely to deceive any person;
- Involve commercial activities or sales, or advertising; or
- Impersonate any person, or misrepresent your identity or affiliation with any person or organization;
Disputes
In the event that either party to these Terms of Service has a dispute relating to or arising from these Terms of Service or the use of the Site, they must immediately notify the other party in writing giving details of the dispute.
If the parties cannot resolve the dispute within fourteen (14) days of receipt of the notice provided for above, the dispute will then be submitted to mediation by a mediator agreed to by the parties, or failing agreement, appointed by JAMS at the request of either party. If the matter is not resolved by mediation within fourteen (14) days from there, the matter will be submitted for arbitration in accordance with the Federal Arbitration Act (9 U.S.C. § 1 et seq.), by a single arbitrator to be appointed by the parties or, failing agreement, appointed by JAMS at the request of either party.
Any such mediation or arbitration shall take place in St. Louis, Missouri, U.S.A. at such location and venue as the parties shall agree or, failing agreement on a location and venue, by such means (including without limitation teleconference or videoconference) as the parties shall agree or, failing agreement, by such means as may be determined by the applicable mediator or arbitrator. Unless the parties agree otherwise, English shall be the sole language of all such proceedings.
All costs in relation to the staging of such proceedings (excluding for the avoidance of doubt any awards which may be made) shall be borne equally by the parties unless explicitly stipulated otherwise by the arbitrator or agreed otherwise by the parties.
BY AGREEING TO THIS ARBITRATION PROVISION, EACH PARTY UNDERSTANDS THAT BOTH YOU AND WE ARE WAIVING THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. BOTH PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THEIR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless the parties agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of representative or class proceeding.
IN THE EVENT YOU HAVE A CLAIM AGAINST SAFESTAPARTMENTS.COM OR ANY THIRD PARTY, RELATING TO, OR ARISING FROM THESE TERMS OF SERVICE, IT WILL BE LIMITED TO MONETARY COMPENSATION AND YOU WILL NOT BE ENTITLED IN ANY CIRCUMSTANCES TO SEEK ANY FORM OF INJUNCTIVE RELIEF OR SPECIFIC PERFORMANCE IN RELATION TO THE SAFESTAPARTMENTS.COM PRODUCTS, USER SUBMISSIONS, MEDIA, THE SAFESTAPARTMENTS.COM WEBSITE, OR OTHERWISE.

- SafestApartments.com does not participate in any actual lease transactions, including, without limitation, negotiations, discussions, or proposals, and you expressly waive any requirement that purports to impose on SafestApartments.com an obligation to perform any services other than those expressly undertaken by SafestApartments.com;
- SafestApartments.com does not render legal, brokerage, or other professional advice or services; in the event you desire or need such services, SafestApartments.com strongly advises you to secure the same;
- SafestApartments.com is not undertaking any, and has no, duties to either Renters or Lessors, including, without limitation, the obligation to inspect rental properties, to verify the veracity of information contained in an advertisement, or to interview or otherwise screen Renters;
- SafestApartments.com is not responsible for the content of, nor does it endorse, the third-party websites to which you may link using this Website;
- SafestApartments.com does not guarantee the accuracy of any information available on the SafestApartments.com website, and is not responsible for any errors, omissions, or misrepresentations, whether made by Lessors, Renters or otherwise and all information obtained on this Website must be verified independently;
- SafestApartments.com may make changes to its products and/or services and this Website or mobile applications at any time and without notifying you or receiving your consent; and
- While SafestApartments.com complies with applicable state and federal laws, including federal civil rights laws, SafestApartments.com cannot guarantee that its users so comply. Accordingly, SafestApartments.com assumes no liability for Renters' and/or Lessors' failures to comply with such laws.
Access and Interference
SafestApartments.com's website may contain robot exclusion headers. Much of the information on SafestApartments.com's website is proprietary or is licensed to SafestApartments.com's website by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the Website for any purpose without our prior written consent. In the case of any violation of our Agreement, SafestApartments.com reserves the right to seek all remedies available by law and in equity for such violations, which may potentially include termination of your use of the Site.
Our License to You and Provided Services
Potential tenants may search the Site in order to find available rental properties that they believe to be suitable in accommodating their needs for free. Subject to the respective restrictions in the SafestApartments.com Terms of Service, we hereby authorize you to copy, view, print one copy of, and download the data and information ("Content") which is available on the Site, given that the following conditions apply:
- the content is not republished, modified, or redistributed
- the content is used explicitly for noncommercial or personal use
- any and all trademark, service mark, copyright, and other proprietary notices are reproduced as they appear in any such Content
Prohibited Unathorized Duplication
Unless explicitly allowed through prior written consent or stated herein, none of the Site Content may be altered, exhibited, sold, duplicated, shared, republished, downloaded, compiled or reformatted, or disseminated in any way or via any channel.
No Brokerage or Lender Relationship
The Site offers an online advertising platform for property managers and prospective tenants in order for the two parties to communicate contact and real estate information with each other. Following any communication, the parties may choose to separately agree and potentially enter a transaction between themselves (each, a "Transaction"), with terms of which SafestApartments.com has no control over.
SafestApartments.com is not a real estate broker, mortgage broker, or lender, and the Site does not and does not intend at any time to provide any real estate or financial guidance to the user. Additionally, we:
- are not a party involved in any Transaction,
- do not guarantee any property or Transaction,
- do not gather, collect or process payments in association with any or specific Transaction,
- do not negotiate or act as a mediator to facilitate the execution any sublease, lease, or sale or rental documentation or legally binding agreements, and/or
- do not provide any consultation or guidance to parties to, or participate in any Transaction,
- do not show properties in any form or manner to prospective tenants.
You acknowledge that if you choose to use the Site, SafestApartments.com does not represent you in any scope and in any Transaction, or in any consultations or negotiations relating to a potential Transaction. Additionally, we highly recommend that you seek assistance from a licensed real estate professional and/or attorney, if applicable, in association with the negotiation and completion of your Transaction.
Adding a Listing
These terms apply to any entity, group of individuals or individual who uses the Listing feature (the "Listing Service") in order to list a property rental or community on SafestApartments.com (the "Site").
By using the Listing Service to advertise on the Site, you acknowledge that SafestApartments.com reserves the right to offer discounts or listing services for free to you or other communities or customers as part of limited offer or special and may elect to charge other communities a fee for the same services if the specials or limited offers are no longer offered under certain circumstances. Additionally, you agree to the following:
- you have the right to lease the property, which may include a unit or a community, that is being advertised
- you either own the right or have the right to advertise the property, unit or community that you are listing, and you have all the relevant rights necessary in order to post and advertise your listings using the Listing Service, which may include but are not limited to all photos, data, text, content
- transmitting to the Site or any user any information or materials of any kind which may violate, plagiarize or infringe on the intellectual property or contractual rights of any third party, or are plagiarized, false, fraudulent, deceptive, tortious, illegal, obscene, pornographic, threatening, harassing, hateful, abusive, vulgar, indecent, libelous, defamatory, racially, ethnically or otherwise objectionable, invasive of privacy or publicity rights, infringing of intellectual property rights, or embarrassing, harmful or injurious to any person or entity, or would constitute or encourage a criminal offense or violate the rights of any person or entity, or would give rise to liability or violate any law; or otherwise objectionable, or contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
- you will not advertise more than one property in an individual listing on the Listing Service, in any shape or form
- if you are utilizing our Customer Portal service, that you are agreeing to lease the property that you are advertising at the price and on any other terms that you have specified in your listing
- if you are utilizing our Customer Portal service and are advertising individual units, that upon leasing those units or otherwise taking your property off the market, that you agree to delete the listing for that property within 72 hours
- you will not utilize the Listing Service or the Site in any way for any false, misleading, or fraudulent activity, or with the intentions to deceive for any noncommerical or commerical reasons
- the property is eligible to be listed using the Listing Service, meaning the property is an apartment for rent and not a sublease for a unit in a multi-family apartment community
- the Listing Service will be used to advertise or promote only the individual property that is being offered for lease, and not any other product, service or business
- you will not use the Listing Service to advertise shared housing
- all Content that you ultimately provide to SafestApartments.com and everything in your listing, is factual, correct and fully comprehensive and that all the Content also complies with all regulations as well as local, state and federal laws, which may also include fair housing laws
- if utilizing our Customer Portal, you are individually held accountable for any and all listings and information provided in your respective listings that you add using our Listing Service, as well as other information you submit to our Site
- photos that you upload to the Listing Service will only show the listed property being advertised for rent and may not include animals, people or individuals, religious symbols, trademarked items, or any other objects or features that are not part of the property, apartment, unit or apartment community
Additionally, by submitting a listing via the Listing Service through the Customer Portal, you give permission to SafestApartments.com, an irrevocable and perpetual license to copy, modify, display, distribute, create derivative works from, or otherwise use and exploit the Content that you submit.
SafestApartments.com reserves the right and at its discretion, to remove any Content or listing from the Listing Service, without prior notice and without liability, if the Content or listing violates our Terms of Service, or other policies, or if SafestApartments.com determines or has reason to believe, in its discretion, that the Content or listing is inappropriate for any reason.Use of Google Maps
The Site provides map views of properties via an API provided by Google Maps. Your use of Google Maps through the Site, or otherwise, is subject to the Google Maps/Google Earth Terms of Service, which include the Google Privacy Policy.
General Limitations
Typically, listings added using the Listing Service will appear on the Site within 24 hours of submission, if submitted through our Customer Portal, and possibly longer if submitted by interaction with our staff.
SAFESTAPARTMENTS.COM DOES NOT MAKE ANY CLAIMS AND WARRANTIES TO YOU REGARDING THE LISTING SERVICE, WHICH INCLUDES ANY WARRANTIES OR REPRESENTATIONS THAT YOU WILL OBTAIN AN ACCEPTABLE RENT FOR YOUR PROPERTY, LEASE YOUR PROPERTY, RECEIVE ANY INQUIRIES REGARDING YOUR PROPERTY FOR RENT, OR ONLY RECEIVE LEGITIMATE INQUIRIES OR SOLICITATIONS FROM QUALIFIED RENTERS.
SafestApartments.com reviews listings added to the Listing Service before and/or after they are posted to the Site to gauge the quality and safety of the apartment or community through publicly available reviews but explicitly states that such reviews may be objective in nature and does not in any make warranty or claims about the quality of the apartment community or living standards. Additionally, we do not guarantee that information relating to the advertised property and advertiser is factual and additionally do not inquire into complaints and apprehensive activity.
Indemnity
You will indemnify and hold our subsidiaries, affiliates, agents, and all employees as well as us, not accountable and harmless from any liability, accountability, fines, cost, charge, claim or demand, which may include court costs, reasonable attorneys' fees, and other costs made by any third party which are arising out of your breach of this Terms of Service, or your violation of the rights of any third party or any law, or incurred by us as a result of your default under this Agreement of the Terms of Service.
Links to Other Third Parties
This site may link you to other sites on the Internet or otherwise include references to information, documents, software, materials and/or services provided by other parties. These sites may contain information or material that some people may find inappropriate or offensive. These other sites and parties are not under our control, and you acknowledge that we are not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites, nor are we responsible for errors or omissions in any references to other parties or their products and services. The inclusion of such a link or reference is provided merely as a convenience and does not imply endorsement of, or association with, the site or party by us, or any warranty of any kind, either express or implied.
Notices
All notices to a party shall be in writing and shall be made either via email or conventional mail. Notices to us must be sent to the attention of Customer Service at contact@safestapartments.com, if by email, or at 12847 Daylight Dr., St. Louis MO 63131, if by conventional mail. Notices to you may be sent to the address supplied by you as part of your Registration Data. In addition, we may broadcast notices or messages through the site to inform you of changes to the site or other matters of importance, and such broadcasts shall constitute notice to you at the time of sending.
Competitor Exclusion
You may not access the Service if you are a direct competitor of SafestApartments.com, except with SafestApartments.com's prior written consent. In addition, you may not access the Service for purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purposes.
You shall not (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Service or the Content in any way; (ii) modify or make derivative works based upon the Service or the Content; (iii) create Internet "links" to the Service or "frame" or "mirror" any Content on any other server or wireless or Internet-based device; or (iv) reverse engineer or access the Service in order to (a) build a competitive product or service, (b) build a product using similar ideas, features, functions or graphics of the Service, or (c) copy any ideas, features, functions or graphics of the Service. User licenses cannot be shared or used by more than one individual User but may be reassigned from time to time to new Users who are replacing former Users who have terminated employment or otherwise changed job status or function and no longer use the Service.
Release
Because the Site is an advertising platform, in the event that you have a dispute with a property/advertiser, you release SafestApartments.com and its affiliates (and its respective officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, or in any way connected with, such disputes.
Coupons and Promotional Offers
Listings appearing on the Sites may contain coupons or other promotional offers ("Coupons"). You may only redeem Coupons if you are 18 years of age or older. You can only redeem Coupons during the promotional period, while supplies last, and any unredeemed Coupon will not have any cash value. Coupons may only be redeemed for the specific property being advertised and no substitution is permitted. You will be subject to the terms, conditions and restrictions mentioned in the Coupon in addition to these Terms. Unless otherwise set forth in the Coupon, permitted by the advertising property, or required under applicable law, the following additional restrictions apply: You cannot redeem the Coupon in combination with other discounts, promotions or offers; and you cannot duplicate use, sell or trade a Coupon. The Coupon will be void if you attempt to redeem it in violation of the terms of the Coupon or these Terms.
IN ADDITION TO THE GENERAL DISCLAIMER OF WARRANTIES AND LIMITATIONS OF LIABILITY APPLICABLE TO THE SITES, WE DISCLAIM ANY AND ALL WARRANTIES AND LIABILITY AS TO ANY ADVERTISING PROPERTY OR THE PRODUCTS OR SERVICES THAT IT OFFERS. SAFESTAPARTMENTS.COM DISCLAIMS ALL WARRANTIES OF QUALITY, SAFETY, USABILITY, MERCHANTABILITY OR FITNESS OF ANY UNDERLYING PRODUCT OR SERVICE REDEEMED BY YOU IN CONNECTION WITH ANY COUPON. AS BETWEEN SAFESTAPARTMENTS.COM AND YOU, YOU AGREE THAT YOU ARE USING THE ADVERTISING PROPERTY'S COUPON AT YOUR SOLE RISK.
Modification of the Site
